STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to citizen complaints against police officers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Police Officers and Watchmen. Amend RSA 105 by inserting after section 18 the following new subdivision:

Citizen Complaints Against Police Officers

105:19 Citizen Complaints Against Police Officers. Upon the filing of 3 or more citizen complaints against a police officer in a 12-month period, the police chief of the city or town which employs the officer shall initiate an investigation of the officer’s conduct, which shall be performed by the investigatory body responsible for such matters in accordance with applicable investigatory procedures. A written report of the findings shall be submitted to the governing body of the city or town in which the officer is employed. The report shall include a recommendation for action to be taken against the officer, if warranted, including reprimand, fine, or dismissal.

2 Effective Date. This act shall take effect 60 days after its passage.
