This bill provides that the term wildlife, as used in the fish and game laws, shall not include livestock in agricultural operations, and removes the authority to regulate certain agricultural operations.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to the definition of wildlife for purposes of regulation by the fish and game department.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Fish and Game; General Provisions; Definition of Wildlife. Amend RSA 207:1, XXXV to read as follows:
XXXV. Wildlife: Refers to all species of mammals, birds, fish, mollusks, crustaceans, amphibians, invertebrates, reptiles or their progeny or eggs which, whether raised in captivity or not, are normally found in a wild state; provided that the term wildlife shall not include livestock, as defined in RSA 21:34-a, II(a)(4), in agricultural operations.
2 Sale of Venison. RSA 212:30-d is repealed and reenacted to read as follows:
212:30-d Sale of Venison.
I. No person shall propagate, possess, import, or offer for sale venison of Virginia white-tailed deer (Odocoileus virginianus), in this state.
II. Any person convicted under this section shall be guilty of a violation if a natural person and guilty of a misdemeanor if any other person.
3 Repeal. RSA 212:30-e, relative to the sale of venison raised by licensed propagators, is repealed.
4 Effective Date. This act shall take effect 60 days after its passage.
