STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to protected shoreland permitting fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Protected Shoreland; Permit Required. RSA 483-B:5-b, I(b) is repealed and reenacted to read as follows:

(b) The permit application fee shall be $50 plus $.07 per square foot of area affected by the proposed activities and shall be deposited in the wetlands and shorelands review fund established under RSA 482-A:3, III. Such fees shall be capped as follows:

(1) For projects that qualify for permit by notification under RSA 483-B:17, X, $50 for restoration of water quality improvement projects and $250 for all other permit by notification projects.

(2) The maximum permit application fee shall be $3,750.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1222-FN - FISCAL NOTE

AN ACT relative to protected shoreland permitting fees.

FISCAL IMPACT:

      The Department of Environmental Services states this bill will decrease restricted revenue by $104,800 in FY 2012, $115,280 in FY 2013, $126,808 in FY 2014, and $139,489 in FY 2015, and increase state restricted expenditures by $79,982 in FY 2012. There is no fiscal impact on county and local revenue and expenditures.

METHODOLOGY:

    The Department of Environmental Services states this bill modifies the fees for protected shoreland permits. The Department receives on average 800 applications per year with the average application fee of $370. Based on this, the Department determined the average project impacts 2,700 square feet. The decrease in the application fee from $100 to $50 and the decrease of the impact fee from $.10 to $.07 per square foot will result in an average application fee of $239, a $104,800 (($100 application fee + (2700* $.10) * 800 applications) – ($50 application fee + (2700* $.07) * 800 applications)) decrease in FY 2012 shoreland and wetlands review fund revenue. The Department assumes applications will increase by 10 percent each year, resulting in shoreland and wetlands review fund revenue decrease of $115,280 in FY 2013, $126,808 in FY 2014 and $139,489 in FY 2015. The Department is not able to determine the fiscal impact for FY 2016 because the fees are due to sunset in FY 2016.

    The Department states with the loss of revenue it will be necessary to layoff two of the five technical staff within shoreland protection responsible for reviewing applications, investigating complaints, pursuing necessary compliance actions and providing public assistance. The Department estimates the cost for termination payouts (includes termination pay, benefits, and unemployment costs) to be $39,991 per individual for a total increase in shoreland and wetlands review fund expenditures of $79,982 to lay off two staff in FY 2012.
