STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to prerecorded political messages.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. RSA 664:14-a, III, relative to prohibiting the delivery of prerecorded political messages to numbers on a federal do not call list, is repealed.

2 Effective Date. This act shall take effect upon its passage.

HB 1232-FN - FISCAL NOTE

AN ACT relative to prerecorded political messages.

FISCAL IMPACT:

      The Judicial Branch states this bill may decrease state expenditures by an indeterminable amount in FY 2012 and each year thereafter. The Department of State and Department of Justice state this bill will have no impact on state expenditures. There will be no impact on state revenues, or county and local revenues or expenditures.

METHODOLOGY:

    The Judicial Branch states this bill would repeal RSA 664:14-a, III, relative to the prohibition of the delivery of political messages to phone numbers on the federal “do not call list”. The Branch states currently violations of RSA 664:14-a, III are punishable by a civil penalty of $5,000 per violation and can also result in actions for damages and equitable relieve, including an injunction. The Branch states this bill could result in fewer civil penalty actions or equitable relief actions in court. The Branch has no information on which to estimate how many civil penalty actions will not be prosecuted or how many fewer equitable actions there may be as a result of this bill. The Branch, however, estimates the average cost of a violation level offense in the district division of the circuit court will be $41.92 in FY 2012 and FY 2013, and $43.02 in FY 2014, and estimates the average cost of a complex equity case in superior court will be $576.05 in FY 2012 and FY 2013, and $602.60 in FY 2014.

    The Department of State states this bill removes the prohibition on making prerecorded political messages to numbers on the “do not call list”. The Department states it will incur no fiscal impact as a result of this bill.

    The Department of Justice states this bill would repeal the prohibition of the delivery of prerecorded political messages to phone numbers on the “do not call list”. The Department states it will incur no fiscal impact as a result of this bill.
