STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to table wines.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Definitions; Table Wine. Amend RSA 175:1, LXIX to read as follows:

LXIX. “Wine-table” means a product obtained by the fermentation of the natural content of fruit or other agricultural products containing sugar and containing more than 6 percent but not more than 15.5 percent alcoholic content by volume at 60 degrees Fahrenheit, or, if classified as a table wine by the commission pursuant to RSA 175:9, containing more than 15.5 percent but not more than 24 percent alcoholic content by volume at 60 degrees Fahrenheit.

2 New Section; Classification as Table Wine. Amend RSA 175 by inserting after section 8 the following new section:

175:9 Classification as Table Wine. The commission shall classify as table wine any product which is not fortified wine and which is obtained by the fermentation of the natural content of fruit or other agricultural products containing sugar and which contains more than 15.5 percent but not more than 24 percent alcoholic content by volume at 60 degrees Fahrenheit.

3 Wine Manufacturer License. Amend RSA 178:8, I to read as follows:

I. Wine manufacturer licensees may ferment fruit or other agricultural products naturally containing sugar to produce table wine containing at least 6 but not more than 15.5 percent alcohol by volume or classified as table wine by the commission pursuant to RSA 175:9, and to produce from that wine fortified wine containing at least 15.5 but not more than 24 percent alcohol by volume.

4 Effective Date. This act shall take effect 60 days after its passage.
