STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to agreements between government units.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Agreements Between Government Units; Purpose. Amend RSA 53-A:1 to read as follows:

53-A:1 Purpose. It is the purpose of this chapter to permit municipalities and counties to make the most efficient use of their powers by enabling them to cooperate with the state and other municipalities and counties on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs and development of local communities.

2 Public Agency Defined. Amend RSA 53-A:2 to read as follows:

53-A:2 Public Agency Defined. For the purposes of this chapter, the term “public agency” shall mean the state and any political subdivision of this state or of any adjoining state and any quasi-municipal corporation, including but not limited to school districts, village districts, regional water districts, and special districts; provided, however, that legislative approval shall be required for any agreement entered into by the state under this chapter.

3 Effective Date. This act shall take effect 60 days after its passage.
