STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT establishing a rest area gas station and retail opportunities commission.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Commission Established. Amend RSA 230 by inserting after section 2 the following new section:

230:2-a Rest Area Gas Station and Retail Opportunities Commission Established.

I. There is established the rest area gas station and retail opportunities commission to examine and plan for the future sale of gasoline at rest areas and to investigate additional locations for liquor stores and the opportunities for establishing convenience stores at interstate rest areas. The commission shall focus on how selling gasoline at rest areas and increasing retail sales may produce revenue for the state and effectively promote New Hampshire’s products and services.

II. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

(c) A member of the governor’s staff, appointed by the governor.

(d) The commissioner of the department of transportation, or designee.

(e) The commissioner of the department of resources and economic development, or designee.

(f) A representative of the Retail Merchant’s Association, appointed by such association.

(g) A representative of a local chamber of commerce, appointed by the governor.

(h) The chairperson of the liquor commission, or designee.

III. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV. The commission shall:

(a) Examine issues associated with the sale of gasoline and liquor at rest areas on interstate highways.

(b) Examine issues associated with establishing convenience stores at rest areas on interstate highways.

(c) Determine a method to evaluate the potential sales for state liquor stores and gasoline stations at each rest area and the order in which sites shall be developed.

V. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.

VI. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the senate president, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2012.

2 Repeal. RSA 230:2-a, relative to the rest area gas station and retail opportunities commission, is repealed.

3 Effective Date.

I. Section 2 of this act shall take effect December 1, 2013.

II. The remainder of this act shall take effect upon its passage.
