STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to reciprocity for nonresident trainers of hunting dogs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fish and Game; Use of Dogs for Hunting Bear; Reciprocity. Amend RSA 207:12-b to read as follows:

207:12-b Restriction on Nonresident’s Dog Training and Use of Dogs for Hunting Bear.

I. Notwithstanding RSA 207:12-a, a nonresident shall not train or use dogs for hunting [any specific wildlife species] bear in this state during the period when residents of New Hampshire are prohibited from training or using dogs for hunting [such wildlife species] bear in the nonresident’s state of residence or province or territory of Canada. This section shall also apply in cases in which the nonresident’s state of residence or province or territory of Canada restricts or limits the number of dog training or dog hunting permits which are issued to citizens of New Hampshire.

II. For the purposes of this section, the executive director shall determine the states, provinces or territories which prohibit or limit New Hampshire residents from the training or use of dogs for hunting bear. Such determination as to the degree of reciprocity shall be final.

III. Notwithstanding paragraph I, a properly licensed New Hampshire guide for bear hunting may guide a properly licensed non-resident, paying client to take bear with the use of dogs even if the client’s state of residence prohibits such taking by residents of New Hampshire. This exception to paragraph I shall not apply to the training of dogs.

2 Effective Date. This act shall take effect 60 days after its passage.
