STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to exceptions for proposed sewage waste disposal systems.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraphs. Amend RSA 485-A:33 by inserting after paragraph III the following new paragraphs:

IV. No plans and specifications shall be required for the repair or replacement of an effluent disposal area serving a structure that is only residential and does not receive anything other than domestic sewage for disposal if:

(a) The effluent disposal area is not within 75 feet of any surface water or water supply well;

(b) The bottom of the bed is more than 24 inches above the seasonal high water table;

(c) There will be no change to the dimensions, location, depth or type of design that existed before the repair or replacement;

(d) The use will not change; and

(e) The flow will not increase.

V. Prior to any repair or replacement of an effluent disposal area exempt from required plans and specifications under paragraph IV, a permitted designer shall:

(a) Evaluate the seasonal high water table in the location of the effluent disposal area by digging a test pit in accordance with departmental rules;

(b) Determine whether the location of the effluent disposal area is within 75 feet of surface waters or water supply wells; and

(c) Submit written notification to the department of the following:

(1) The date of the evaluation;

(2) The name, the original permit number under RSA 485-A:36, mailing address, and daytime phone number of the permitted designer who completed the evaluation;

(3) The name, mailing address and daytime phone number of the owner of the property;

(4) The location of the property on which the individual sewage disposal system is located, by street address, town, and tax map lot number;

(5) The construction approval number for the existing individual sewage disposal system, if available; and

(6) Information on the test pit or pits dug, including test pit numbers, the date the test pits were dug, and the results of the test pit.

2 Effective Date. This act shall take effect upon its passage.
