STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT requiring public access to any document and Internet content which is incorporated by reference in administrative rules.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Administrative Rules; Public Access to Documents and Internet Contents Incorporated by Reference. Amend RSA 541-A:12 by inserting after paragraph IV the following new paragraph:

IV-a. Each agency shall, upon request for a copy of any document or Internet content incorporated by reference in the agency’s rules, make available for inspection and copying any such document or downloaded Internet content. If a computer, photocopying machine, or other device maintained for use by the agency is used by the agency to copy the document or downloaded Internet content requested, the person requesting the copy may be charged the actual cost of providing the copy, which cost may be collected by the agency. Nothing in this section shall exempt any person from paying fees otherwise established by law for obtaining copies of documents, but if such fee is established for the copy, no additional costs or fees shall be charged.

2 Effective Date. This act shall take effect 60 days after its passage.
