AN ACT relative to workers’ compensation coverage and safety program requirements in state contracts.

ANALYSIS

This bill requires the insurance commissioner to accept a rider listing the state of New Hampshire for purposes of a certificate of compliance for workers’ compensation purposes under certain circumstances. This bill also clarifies safety program requirements for certain contractors working on state projects.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to workers’ compensation coverage and safety program requirements in state contracts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Workers’ Compensation; Certificates of Insurance. Amend RSA 412:37-a to read as follows:

412:37-a Certificates of Insurance.

I. Every certificate of insurance issued or presented in this state pursuant to a workers’ compensation insurance policy shall contain the following information:

[I.] (a) All states for which such statutory coverage is provided;

[II.] (b) Names of all executive officers or members who are excluded, if any, pursuant to RSA 281-A:18-a, or a notation that no executive officers or members are excluded; and

[III.] (c) Names of all sole proprietors or partners who have elected to be covered under the policy or a notation that no sole proprietors or partners are covered.

II. For any person or entity entering this state in the middle of an insurance policy, the commissioner shall accept a rider listing the state of New Hampshire in satisfaction of the requirements of subparagraph (a) of this section.

2 State Projects. Amend RSA 21-I:80, VI(a)(4) to read as follows:

(4) A copy of the contractor’s compliance with a current written safety program, if applicable, as filed with the commissioner of labor under RSA 281-A:64, II; provided that an out-of-state contractor from a state with an appropriate safety program may satisfy this subparagraph and provided further that if such out-of-state contractor has fewer than 10 employees such contractor shall be exempt from the safety program requirement under this subparagraph and proof of an existing joint loss management committee as required under RSA 281-A:64, III, if applicable; and

3 Effective Date. This act shall take effect 60 days after its passage.
