STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to conflicts of interest.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Conflicts of Interest. Amend RSA by inserting after chapter 20-B the following new chapter:

CHAPTER 20-C

CONFLICTS OF INTEREST

20-C:1 Duty to Recuse. Every employee of the state or any of its political subdivisions shall recuse himself or herself from participating in any decision-making process that occurs in the course of his or her employment, when such decision involves a conflict of interest as defined in RSA 21-G:21.

2 New Section; Conflict of Interest. Amend RSA 31 by inserting after section 4-a the following new section:

31:4-b Conflict of Interest. Every elected or appointed official of a town, every member of a board or commission of a town, and every employee of a town shall recuse himself or herself from participating in any decision-making process that occurs in the course of his or her term, membership, or employment, when such decision involves a conflict of interest as defined in RSA 21-G:21.

3 Effective Date. This act shall take effect 60 days after its passage.
