AN ACT relative to conflicts of interest of a member of the general court.

ANALYSIS

This bill requires that a financial interest creating a conflict of interest for a member of the general court shall prohibit participation in any official activity associated with the matter.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to conflicts of interest of a member of the general court.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Legislative Ethics; Financial Disclosure; Conflicts of Interest. RSA 14-B:8, V is repealed and reenacted to read as follows:

V. The following statement on procedure for a conflict of interest: “A conflict of interest is the condition in which a legislator has a financial interest in any official activity. When a legislator becomes aware that a conflict of interest exists or may exist, the legislator shall not participate in any official activity associated with the matter.”

2 Legislative Ethics Committee; Amendment of Guidelines and Forms. Within 90 days of the effective date of this act the legislative ethics committee shall adopt changes to the ethics guidelines and appropriate forms to implement the requirements of RSA 14-B:8, V as amended by section 1 of this act. Such ethics guidelines changes shall provide that conflict of interest statements by members of the general court filed with the house or senate clerk shall be transmitted to the legislative ethics committee within 5 days of their filing by the legislator and shall be made available to the public by the legislative ethics committee within 2 days of receipt from the house or senate clerk.

3 Effective Date. This act shall take effect 60 days after its passage.
