STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the regulation of home health care providers by the department of health and human services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Home Health Care Providers. Amend RSA 151:2-b, I-III to read as follows:

I. “Home health care provider” means any natural person, organization, business entity, or subdivision thereof, whether public or private, whether operated for profit or not, which is engaged in arranging or providing, directly or through contract arrangement, one or more of the following: nursing services, home health aide services, or other therapeutic and related services which may include, but shall not be limited to, physical and occupational therapy, speech pathology, nutritional services, medical social services, personal care services, and homemaker services, which may be of a preventive, therapeutic, rehabilitative, health guidance or supportive nature to persons in their places of residence.

II. Home health care providers which provide only homemaker services and no other health care services as listed in paragraph I of this section shall be issued a license or, in the case of natural persons, a mandatory registration, limiting their services to homemaker services.

III. Home health care providers that provide only personal care services and no other health care services as listed in paragraph I of this section shall be issued a license or, in the case of natural persons, a mandatory registration, limiting their services to personal care services.

2 Rules for Home Health Care Providers. Amend the introductory paragraph of RSA 151:9-a to read as follows:

The commissioner of the department of health and human services shall adopt rules under RSA 541-A, relative to the licensing and mandatory registration of home health care providers that are separate from rules relative to other health facilities. Such rules shall be subject to the requirements of RSA 151:9, II-V and RSA 151:9, IX and shall include the following:

3 New Paragraph; Rules for Home Health Care Providers. Amend RSA 151:9-a by inserting after paragraph I the following new paragraph:

I-a. General requirements for mandatory registration of home health care providers who are natural persons and who provide only homemaker services, personal care services, or both. Requirements for mandatory registration shall include, at a minimum, a criminal background check and a state registry check. Such persons, because they operate as individuals and provide a limited scope of services are not subject to full licensure under this chapter.

4 Effective Date. This act shall take effect 60 days after its passage.
