STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to smoking within certain areas of New Hampshire state parks and historic sites.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Smoking in Congregate Areas of State Parks and Historic Sites. Amend RSA 12-A by inserting after section 61 the following new subdivision:

Smoking in Congregate Areas of State Parks and Historic Sites

12-A:62 Smoking in Congregate Areas of State Parks and Historic Sites Discouraged; Exception.

I. In this subdivision:

(a) “Congregate area” means restrooms and places where people gather for events inside or outside, including tours, eating, relaxation, recreation, or information and learning. “Congregate area” also includes, but is not limited to, playgrounds, picnic areas, gazebos, pavilions, portions of beaches in state parks, and outside stage areas where there may be seating that is fixed or brought by attendees.

(b) “Smoking” means having in one’s possession a lighted cigarette, cigar, or pipe, or any device or product designed to produce the effect of smoking.

II. Smoking shall be discouraged in congregate areas of state parks and historic sites.

III. The commissioner of the department of resources and economic development may cause signs to be erected, undertake public education initiatives, and partner with public health organizations and other interested parties in his or her efforts to further the objectives of this subdivision.

IV. This section shall not apply to open air venues rented for private use including, but not limited to campsites and picnic pavilions.

2 Effective Date. This act shall take effect 45 days after its passage.
