AN ACT relative to polling hours and location of polling places.

ANALYSIS

This requires cities and towns to notify the secretary of changes in polling hours and the location of polling places. The secretary of state shall post the changes on the state website and may order extended hours of polling if a city or town fails to report the changes.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to polling hours and location of polling places.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Election Procedure; Additional Polling Places; Report of Changes. Amend RSA 659 by inserting after section 4-a the following new section:

659:4-b Report of Changes.

I. Cities and towns shall report any changes in polling hours or the location of the central polling place or any additional polling place to the secretary of state within 3 business days of the change, but in no case later than 5:00 p.m. on the Friday before the election. When reporting a change in location of a polling place, cities and towns shall include the street address of the new location.

II. The secretary of state shall post any changes in polling hours or the location of the central polling place or any additional polling place on the secretary of state’s website. If the secretary of state receives a report of any such changes at least 7 days before the election, he or she shall post such changes within 48 hours of receiving the report. If the secretary of state receives a report of any such changes less than 7 days before the election, he or she shall post such changes by noon on the business day following receipt of the report.

III. If a city or town fails to report any change in accordance with paragraph I, the secretary of state may order such additional polling hours for the polling place as he or she deems necessary.

2 Effective Date. This act shall take effect 60 days after its passage.
