STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
A RESOLUTION informing the United States Congress that it is the desire of the general court of New Hampshire that the New Hampshire national guard shall not serve outside the borders of New Hampshire absent a declaration of war.
Be it Enacted by the Senate and House of Representatives in General Court convened:
Whereas, the Constitution of the United States clearly states that the power to declare war belongs to the legislative branch, not to the executive branch; and
Whereas, the New Hampshire national guard has been summoned to serve in 2 armed conflicts in Iraq and in Afghanistan without a congressional declaration of war; and
Whereas, such actions recklessly put our troops in harms way; now, therefore, be it
Resolved by the Senate and House of Representatives in General Court convened:
That the United States Congress is hereby informed that absent a formal congressional declaration of war, it is the desire of the general court of New Hampshire that the New Hampshire national guard is not to be called to serve outside the borders of the state of New Hampshire; and
That the general court urges that any federal or state office holders or military officers who attempt to order the New Hampshire national guard to serve outside of New Hampshire or attempt to comply with such orders be prosecuted for violation of their oath of office and further, if convicted, be removed from office and returned to their civilian occupations; and
That copies of this resolution, signed by the speaker of the house of representatives and the senate president, be forwarded by the house clerk to the speaker of the United States House of Representatives, the President of the United States Senate, and to each member of the New Hampshire congressional delegation.
