AN ACT relative to the exchange of public health information through a health information exchange.

This bill allows health care providers who are required to submit data to the department of health and human services to submit such data through a health information exchange under certain circumstances.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the exchange of public health information through a health information exchange.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Medical Records and Patient Information. Amend RSA 332-I:3, I to read as follows:

I. Except as provided in paragraph VI, a health care provider or a business associate of a health care provider may transmit an individual's protected health information through the health information organization. [Only a health care provider, for purposes of treatment, may have access to protected health information transmitted through the health information organization.]

2 New Paragraph; Authorizing Certain Health Care Providers to Submit Data to a Health Information Exchange. Amend RSA 332-I:3 by inserting after paragraph VII the following new paragraph:

VIII. Health care providers otherwise required or authorized by law to submit data to the department of health and human services may do so through a health information exchange; provided, that such transmissions meet the same standards for privacy and security of protected health information that apply when such information is exchanged between providers.

3 Effective Date. This act shall take effect upon its passage.
