STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT requiring nursing facilities to have at least one automated external defibrillator.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Nursing Facilities; Automated External Defibrillator. Amend RSA 151-E by inserting after section 18 the following new section:
151-E:19 Automated External Defibrillator Required in Nursing Facilities.
I. In this section, “automated external defibrillator” means a medical device which combines a heart monitor and defibrillator and:
(a) Has been approved by the United States Food and Drug Administration;
(b) Is capable of recognizing the presence or absence of ventricular fibrillation;
(c) Is capable of determining whether defibrillation should be performed; and
(d) Automatically charges and requests delivery of an electrical impulse to an individual's heart, upon determination that defibrillation should be performed.
II. Each nursing facility shall maintain on its premises at least one automated external defibrillator.
2 Effective Date. This act shall take effect 60 days after its passage.

FISCAL IMPACT:
The Legislative Budget Assistant has determined that this legislation has a total fiscal impact of less than $10,000 in each of the fiscal years 2012 through 2016.
