STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to property held for water supply or flood control.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Current Use Taxation; Open Space Land; Water Supply. Amend RSA 79-A:2, IX to read as follows:

IX. “Open space land” means any or all farm land, forest land, or unproductive land as defined by this section. [However,] “Open space land” shall [not] include [any] property which qualifies for current use assessment held by a city, town, or district in another city or town for the purpose of a water supply or flood control, for which a payment in place of taxes is made in accordance with RSA 72:11.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 337-FN-LOCAL - FISCAL NOTE

AN ACT relative to property held for water supply or flood control.

FISCAL IMPACT:

      The Department of Revenue Administration and New Hampshire Municipal Association state this bill will decrease local revenues and expenditures by indeterminable amounts in FY 2012 and each year thereafter. There will be no impact on state and county revenues or expenditures.

METHODOLOGY:

    The Department of Revenue Administration states this bill would result in a slight decrease in the cost of payments from municipalities that own flood control or water supply land in located in another municipality by allowing for the application of current use values to that land. Accordingly, the Department states there would be a slight decrease in revenues for municipalities who host such land.

    The New Hampshire Municipal Association states this bill would lower the assessed valuation for land held for flood control or water supply in another city or town on which a payment-in-lieu-of-taxes (PILOT) is made. The Association states this bill will result in a decrease in both local expenditures and local revenues, as payments from one municipality to another would be reduced. The Association is unable to determine a fiscal impact as it does not have data relative to the assessed valuation of land held nor the amount of the PILOTs on those properties.
