ANALYSIS

This bill allows suspension of the registration privilege for paying a motor vehicle permit fee with a bad check; current law allows suspension of the registration certificate and number plates.

This bill was requested by the department of safety.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to collection of permit fees paid with insufficient fund checks.

Be it Enacted by the Senate and House of Representatives in General Court convened:

15:1 Municipal Permits for Registration; Collection of Insufficient Fund Checks. Amend RSA?261:156 to read as follows:

261:156 Collection of Insufficient Fund Checks. The director, upon receipt of a complaint from the city official whom the city government may designate, or the town clerk of a town that a person has paid a permit fee with a bad check as defined in RSA 638:4, may suspend the registration [certificate and number plates] privilege of such person until the city official or town clerk has been reimbursed the full amount of such check and any protest fees. The suspension of a registration [certificate or number plates] privilege under the provisions of this section shall not limit criminal prosecution under RSA 638:4.

15:2 Effective Date. This act shall take effect January 1, 2014.
