STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to online availability of certain county budget information and reports.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Purpose. The purpose of this act is to promote transparency in county meetings and the county budget process by providing the public access to budget, expenditure, and revenue information and county reports which are not confidential and which are vital to good government.

2 New Chapter; Online Access to Budget Information and Reports. Amend RSA by inserting after chapter 30-B the following new chapter:

CHAPTER 30-C

ONLINE ACCESS TO BUDGET INFORMATION AND REPORTS

30-C:1 Online Access to Budget Information and Reports.

I. The county commissioners shall make available on the county website the information and reports required to be made available to the public.

II. The county website shall include the following:

(a) Contact information for elected and appointed county officials.

(b) Notice of regular and special meetings including agendas and approved minutes of regular and special meetings in accordance with RSA 91-A.

(c) Annual proposed budget and approved budget as approved by the county convention, including estimated and actual revenues and expenditures.

(d) Annual financial reports and audit reports, including financial or performance audits.

(e) Annual reports of county officers in accordance with RSA 30:1.

(f) Grant applications filed by any county department.

(g) Requests for proposals, bid requests, and resulting contracts. In any instance when competitive bidding is waived, the contract shall be made available online along with commissioners’ statement on the reasons therefore in accordance with RSA 28:8.

III. Nothing in this chapter shall be construed to require the public posting or dissemination of information exempt from public disclosure under RSA 91-A or other law.

3 Effective Date. This act shall take effect 60 days after its passage.
