AN ACT relative to the cost of railroad crossings upon the restoration of rail service.

ANALYSIS

This bill requires any railroad that restores service to a track to be responsible for the cost of constructing crossings at previously existing crossing sites for access by landowners.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the cost of railroad crossings upon the restoration of rail service.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Restoration of Railroad Crossings. Amend RSA 228 by inserting after section 67 the following new section:

228:67-a Restoration of Crossings. Any railroad, whether privately or state-owned, that restores service to an unused track shall be responsible for the cost of constructing tunnels or overpasses at previously existing crossing sites where an owner’s property is on both sides of the railroad property, or is on one side if the railroad separates such property from the public highway.

2 Effective Date. This act shall take effect 60 days after its passage.
