STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to requirements for whitewater guides.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Whitewater Guides. Amend RSA 270-D by inserting after section 20 the following new subdivision:

Whitewater Guides

270-D:21 Whitewater Guides.

I. Any person engaged in the commercial enterprise of guiding passengers in whitewater craft on trips on rapidly flowing rivers in this state shall comply with the following:

(a) The guide operating the whitewater craft shall be required to show, upon request of the commissioner, or designee, proof of safety training for whitewater craft guiding.

(b) Maintain on each craft for the use of passengers appropriate emergency and safety gear.

II. In this subdivision, “whitewater craft” means any raft, dory, bateau or similar watercraft that is used to transport passengers along rapidly flowing rivers or streams but does not include canoes or kayaks.

270-D:22 Rulemaking. The commissioner shall adopt rules under RSA 541-A relative to the following:

I. A list of the rapidly flowing rivers in the state to which this subdivision shall apply.

II. The minimum safety training requirements for persons engaged in the commercial enterprise of guiding passengers in whitewater craft on trips on rapidly flowing rivers in this state.

III. The minimum emergency and safety gear, including PFDs and headgear for all guides and passengers, required for commercial whitewater craft and guides.

270-D:23 Penalties Any person who violates any provisions of this subdivision or any rule adopted under RSA 270-D:22 shall be guilty of a violation.

2 Effective Date. This act shall take effect 60 days after its passage.
