STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to a selectman serving on the school board.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Regular School Districts; Board. Amend RSA 671:4 to read as follows:

671:4 Board.

I. A school district which is not a cooperative school district as defined in RSA 195:1 may have a school board of 3, 5, 7, or 9 members, including the board of selectmen representative to the school board as provided in paragraph II, as it shall determine by vote at any annual meeting. They shall serve for a term of 3 years, provided that the board of selectmen representative to the school board shall serve a term coterminous with his or her term of office. Insofar as possible, an equal number of the members shall be elected at each school district election. Whenever such a district determines to change the number of board members, it shall also determine the number of members to be elected each year. Such change shall not take effect until the school district election in the year next following the one in which the change is voted. The board will increase or decrease in membership so that there will always be an uneven number of members until the desired number is reached. The school board of a district which does not otherwise vote shall have 3 members.

II. A town, in accordance with the local procedure for proposing and adopting ballot questions, may vote to authorize the board of selectmen to appoint one selectman to serve as the board of selectmen representative to the school board. The selectman shall serve as a voting member on the school board. Where a school board represents multiple towns, each town may, in accordance with the local procedure for proposing and adopting ballot questions, authorize the board of selectmen to appoint one selectman to serve as the board of selectmen representative to the school board. Each selectman in this case shall serve as a voting member of the school board.

2 Effective Date. This act shall take effect 60 days after its passage.
