STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT establishing a state house flag restoration commission and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; State House Flag Restoration Commission Established. Amend RSA 14 by inserting after section 49 the following new section:

14:49-a State House Flag Restoration Commission.

I. There is hereby established a state house flag restoration commission, the purpose of which shall be to conduct a study regarding restoration, conservation, and preservation of the flags for display in the hall of flags in the state house and to hire necessary personnel to commence the restoration project. The members of the commission shall be the following:

(a) Two members of the senate, appointed by the senate president.

(b) Two members of the house of representatives, appointed by the speaker of the house.

(c) The state curator.

(d) The chairman of the joint legislative historical committee, established in RSA 17-I:1, or designee.

II. The commission shall select one of its members to act as chairman. The commission may authorize the chairman to hire such professionals as are required and may expend such resources, within the limits of the appropriation, as may be necessary.

III. The members of the commission shall serve without compensation, except that the legislative members shall receive mileage at the legislative rate when attending to the duties of the commission.

IV. The primary duty of the commission shall be to conduct a study, make recommendations, hire restoration personnel, and commence restoration and preservation of the flags displayed in the hall of flags of the state house. The commission's duties shall include, but not be limited to, the following:

(a) Conduct a study and prepare a report including an evaluation of different restoration and conservation options, a professional evaluation of restorability or condition report of individual items in the collection, and recommendations regarding display and storage of the collection.

(b) Establish project schedules and timetables, project expenses including an estimate of total renovation, display, and continuing management costs, and propose a budget for the recommended expenses.

(c) Obtain a professional condition report of each item in the collection.

(d) Establish specific conservation measures.

(e) Establish a plan for continuing management and conservation.

V. The chairman, with the consent of the commission, may hire consultants as required, subject to budgetary limitations.

VI. The chairman, with the consent of the commission, may hire a professional textile restorer or other suitable professional to commence the restoration work within budgetary limitations under the supervision and direction of the state curator.

VII. Notwithstanding any other provision of law, the commission may receive gifts, grants or donations of any kind made for the restoration, preservation, and display of the flag collection. All monetary grants, gifts, or donations shall be deposited in the general court flag restoration and care account and may be expended by the commission in the performance of its duties.

VIII. The commission shall submit an interim report of its findings and recommendations to the senate president, the speaker of the house of representatives, and the governor on or before November 1, 2013. The commission shall submit a final report on or before July 1, 2015.

2 Appropriation. The sum of $25,000 for the biennium ending June 30, 2015, is hereby appropriated to the general court for deposit in the flag restoration and care account for the purposes of this act. This appropriation shall be nonlapsing. The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

3 Repeal. RSA 14:49-a, relative to the state house flag restoration commission, is repealed.

4 Effective Date.

I. Section 3 of this act shall take effect July 1, 2015.

II. The remainder of this act shall take effect upon its passage.

SB 119-FN-A - FISCAL NOTE

AN ACT establishing a state house flag restoration commission and making an appropriation therefor.

FISCAL IMPACT:

      The Office of Legislative Budget Assistant states this bill, as introduced, will increase state general fund expenditures by $25,000 in FY 2014. There is no fiscal impact on county and local expenditures, or state, county, and local revenue.

      This bill appropriates $25,000 from the state general fund to the General Court for the biennium ending June 30, 2015 for the purpose of this act.

METHODOLOGY:

    The Office of Legislative Budget Assistant states this bill establishes a state house flag restoration commission and makes a nonlapsing general fund appropriation of $25,000 for the biennium ending June 30, 2015 for the purpose of this act. This bill will increase state expenditures by $25,000 in FY 2014.
