This bill declares that it is the duty of the prosecutor to maintain a register of persons who have been required to attend court for the state for the purposes of witness fees.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the payment of witness fees in criminal cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Payment of Witnesses in Criminal Cases. Amend RSA 592-A:12 to read as follows:

592-A:12 Payment of Witnesses in Criminal Cases. Any person who attends any court for the state in criminal cases pursuant to subpoena shall be paid the witness fees provided by RSA 516:16. It shall be the duty of the [clerk of court] prosecutor to maintain a register of all persons who have been required to attend court for the state. The prosecutor shall forward the register to the attorney general who shall pay all witness fees to all persons who are entitled to such fees. The attorney general shall adopt rules, pursuant to RSA 541-A, relative to the payment of witness fees under this section.

2 Effective Date. This act shall take effect January 1, 2014.
