STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT prohibiting an immediate family member of a school board member from being employed by the school district.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 School District Elections; Qualifications. Amend RSA 671:18 to read as follows:

671:18 Qualifications. To become a candidate for any school district office, a person must be a registered voter in the district. No person holding the office of member of the school board shall at the same time hold the office of district moderator, treasurer, or auditor. No person or immediate family member of such person who is employed on a salaried basis by a school administrative unit or by any school district within a school administrative unit shall be a school board member in any district of the school administrative unit. Salaried positions shall include, but are not limited to, the following: teacher, custodian, administrator, secretary, school bus driver (if paid by the district), school lunch worker and teacher's aide. In this section, “immediate family member” means anyone related to and living in the same domicile as that person who shares a common economic interest in the expenses of daily living.

2 Effective Date. This act shall take effect 60 days after its passage.
