AN ACT relative to an exemption for entities that furnish hot water through a district energy system.

ANALYSIS

This bill exempts any entity that manufactures or sells hot water through a district energy system that uses the waste heat from one or more persons being served by such system from being a public utility.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to an exemption for entities that furnish hot water through a district energy system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Hot Water Companies; When Public Utilities. Amend RSA 362 by inserting after section 4-c the following new section:

362:4-d Hot Water Companies; When Public Utilities. The term “public utility” shall not include any corporation, company, association, joint stock association, partnership, and person, their lessee, trustee, or receiver appointed by any court, or assignee, engaged in the manufacture, furnishing, or sale of hot water through a district energy system that makes use in whole or in part of the waste heat from one or more of the persons or entities being served by such system.

2 Effective Date. This act shall take effect 60 days after its passage.
