AN ACT relative to limitations on ethanol in gasoline.

AMENDED ANALYSIS

This bill restricts the addition of corn-based ethanol gasoline additives to no more than 10 percent of the mixture of gasoline. This restriction shall not take effect until passage of similar legislation occurs in 2 other New England states.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to limitations on ethanol in gasoline.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Corn-Based Ethanol Prohibited. Amend RSA 339-B by inserting after section 8 the following new section:

339-B:8-a Corn-Based Ethanol; Ratio of Additive to Gasoline. No seller of gasoline shall sell or offer for sale gasoline that has corn-based ethanol as an additive where the corn-based ethanol additive is more than 10 percent of the mixture of gasoline.

2 Contingency. If any 2 New England states adopt similar legislation limiting the amount of corn based ethanol in gasoline to 10 percent, section 1 of this act shall take effect upon the certification of the commissioner of the department of environmental services to the secretary of state and the office of legislative services that such states have enacted such legislation.

3 Effective Date.

I. Section 1 of this act shall take effect as provided in section 2 of this act.

II. The remainder of this act shall take effect upon its passage.
