AN ACT relative to allocations of funds from the highway fund.

ANALYSIS

This bill requires that 100 percent of funds appropriated to the highway fund shall be used by the department of transportation for the construction, reconstruction, and maintenance of public highways within this state.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to allocations of funds from the highway fund.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Allocation of Appropriations from the Highway Fund. Amend RSA 9:9-b to read as follows:

9:9-b Allocation of Gross Appropriations From Highway Fund. For each fiscal year of the biennium, gross highway fund appropriations net of highway block grant aid, shall be allocated in the operating budget as follows:

I. Department of transportation[, including the office of information technology]: Not less than [73] 100 percent of which up to one percent shall be used for the supervision of traffic on public highways within the state.

II. Department of safety: Not to exceed [26] zero percent.

III. Other projects that comply with part 2, article 6-a of the New Hampshire constitution, relative to the use of highway funds: Not to exceed [1] zero percent.

IV. All revenue in excess of the necessary cost of collection and administration accruing to the state from registration fees, operators’ licenses, gasoline road tolls, or any other special charges or taxes with respect to the operation of motor vehicles or the sale or consumption of motor vehicle fuels shall be credited to the highway fund. No expenditure by the department of transportation of funds in the highway fund shall be other than in compliance with part 2, article 6-a of the New Hampshire constitution, relative to the use of highway funds, and otherwise shall be limited exclusively for the construction, reconstruction, and maintenance of public highways within this state, including the supervision of traffic thereon and payment of the interest and principal of obligations incurred for said purposes; and no part of such revenues shall, by transfer of funds or otherwise, be diverted to any other purpose whatsoever.

2 Effective Date. This act shall take effect July 1, 2014.
