STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to providing an education plan for certain students upon request of a parent or guardian.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; State Board of Education; Duties. Amend RSA 186:11 by inserting after paragraph XXXVI the following new paragraph:

XXXVII. Education Plans. Require school districts to adopt a policy requiring all public schools, including chartered public schools, to provide, upon request of a parent or legal guardian, an education plan for any pupil who does not have an individualized education plan pursuant to RSA?186-C:7 or who is not receiving English as a second language services, and who has not attained competency at his or her grade level by grades 3, 8, or 11 in mathematics or English/language arts, such pupil with an opportunity to attain competency at grade level.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1445-FN - FISCAL NOTE

AN ACT relative to providing an education plan for certain students upon request of a parent or guardian.

FISCAL IMPACT:

    The Department of Education states this bill, as introduced, would increase expenditures by an indeterminable amount in FY 2014 and each year thereafter. There will be no impact on state, county and local revenue, or state and county expenditures.

METHODOLOGY:

    The Department of Education stats this bill requires local school districts to adopt a policy requiring a school to provide an education plan for certain students who have no attained competency a grade level. The Department states this bill requires a significant effort from local districts in terms of school board oversight and district personnel to develop individual plans and therefore would result in an indeterminable impact on local expenditures.
