STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT requiring each school district to establish a special education parent advisory council.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Special Education; Special Education Parent Advisory Councils. Amend RSA 186-C by inserting after section 3-b the following new section:

186-C:3-c Special Education Parent Advisory Councils.

I. The school board of every school district and any city maintaining a school department within its corporate organization, shall establish a special education parent advisory council. Membership shall be offered to any parent of a child with a disability and any other interested parties. The parent advisory council duties shall include but not be limited to: advising the school on matters that pertain to the education and safety of children with a disability; meeting regularly with school officials to participate in the planning, development, and evaluation of the school board's special education programs, conducting fundraising activities; and accepting gifts, grants, and donations to support its objectives. The parent advisory council shall establish by-laws regarding officers and operational procedures. In the course of its duties under this section, the parent advisory council shall receive assistance from the school district without charge, upon reasonable notice, and subject to the availability of staff and resources.

II. Each school district and city maintaining a school department within its corporate organization shall conduct, in cooperation with the parent advisory council, at least one workshop annually within the school district on the rights of children with a disability and their parents under the special education laws of the state and the federal government and shall make written materials explaining such rights available upon request.

2 Effective Date. This act shall take effect 60 days after its passage.
