STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to notice of driver’s license suspensions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Suspension or Revocation for Default, Noncompliance, or Nonpayment of Fine; Notice. Amend RSA 263:56-a, I(d) to read as follows:

(d) If a defendant receives a summons [in hand from a law enforcement officer, no further notification to such defendant is required before the suspension of his driving privileges occurs as provided in subparagraph I(c). If a defendant receives a summons in any manner other than in hand by a law enforcement officer], the court or director, as applicable, shall notify such defendant by [certified] mail at his or her last known address, before the suspension of his or her driving privileges occurs, as provided in subparagraph I(c), that his or her driving privileges shall be suspended 30 days after the mailing of such notification.

2 Suspension or Revocation for Default, Noncompliance, or Nonpayment of Fine; Notice. Amend RSA 263:56-a, I-a to read as follows:

I-a. The department shall cause [written] notice to be sent by mail addressed to the license holder's last known address, and, if the license holder has so elected, by electronic, telephonic, or other means to any driver licensed by or person whose vehicle is registered by the state of New Hampshire who defaults as otherwise provided in this section on an appearance, summons, or court order issued in this state. Any person who defaults as provided in subparagraph I(c) shall be required to produce proof of satisfaction of the default either in hand or through the court to the department.

3 Effective Date. This act shall take effect January 1, 2015.

HB 1585-FN - FISCAL NOTE

AN ACT relative to notice of driver’s license suspensions.

FISCAL IMPACT:

    The Department of Safety states this bill, as introduced, will increase state highway fund expenditures by $19,250 in FY 2015. There will be no impact on state revenue, or county and local revenues or expenditures.

METHODOLOGY:

    The Department of Safety states this bill modifies the notification requirements for the suspension or revocation of a person’s driver’s license. Currently all notices are mailed to the citizen’s last known mailing address and this bill allows for such notification to be made telephonic, electronic, or other means. The Department states it would need to make programming changes to its current software to allow for the additional field for a citizens e-mail address. The Department estimates these costs to total $19,250 (110 labor hours @ $175/hour) in FY 2015.

    The Judicial Branch states this bill will have no impact on its revenues or expenditures.
