AN ACT relative to the definition of a gift to an elected official, public official, public employee, constitutional official, or legislative employee.

ANALYSIS

This bill increases the value of a gift under RSA 15-B concerning gifts, honorariums, and expense reimbursements which is deemed to be of insignificant economic value. This bill also excludes certain items provided to state legislators from the definition of gift under RSA?15-B.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the definition of a gift to an elected official, public official, public employee, constitutional official, or legislative employee.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Gifts, Honorariums, and Expense Reimbursements; Definition of Gift. Amend RSA 15-B:2, I(a)(2) to read as follows:

(2) Any other tangible thing, intangible thing, service, or the use thereof having more than insignificant economic value. Any such item with a value of less than [$25] $100 until January 1, 2014, and thereafter $100 plus the amount the Northeast Consumer Price Index rises in the prior year as adjusted annually by the state treasurer, is presumed to be of insignificant economic value.

2 New Subparagraph; Definition of Gift; Exclusion Added. Amend RSA 15-B:2, V(b) by inserting after subparagraph (13) the following new subparagraph:

(14) The use of passes for use of or entry to an operation or attraction owned by the state and provided by a state agency to members of the general court.

3 Duty to Report; General Court Member or Employee. Amend RSA 15-B:6, II to read as follows:

II. An elected member of the general court or legislative employee who consumes meals or beverages with a value of greater than [$25] the amount specified in RSA 15-B:2, I(a)(2) at a meeting or event pertaining to official business pursuant to RSA 15-B:2, V(b)(12) shall file a report with the secretary of state no later than 10 days following the meeting or event at which the meals or beverages were consumed, which report shall be established by the secretary of state, shall be public, and shall contain the same information and affirmations required under RSA 15-B:7.

4 Effective Date. This act shall take effect 60 days after its passage.
