STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT providing for collection of the E-911 surcharge from certain prepaid cellular telephones.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Providing for Collection of the E-911 Surcharge from Certain Prepaid Cellular Telephones. Amend RSA 106-H:9, I by inserting after subparagraph (e) the following new subparagraph:
(f) The enhanced 911 monthly surcharge established in this chapter is also levied on prepaid wireless telephone service subscribers whose mobile set telephone numbers are assigned to the state of New Hampshire. Providers of prepaid wireless telephone service shall collect and remit the service charge under one of the following methods:
(1) The monthly surcharge on prepaid wireless service shall be remitted in any manner consistent with the wireless provider’s existing operating or technological abilities, such as customer address, location associated with the mobile telephone number, or other reasonable allocation method approved by the E-911 commission and based upon other comparable relevant data. If direct billing is not feasible, the prepaid subscriber’s account shall be reduced by the surcharge amount or an equivalent number of minutes.
(2) The service provider shall collect on a monthly basis the E-911 surcharge from each prepaid wireless telephone service customer whose account balance on the last day of the month is equal to or greater than the amount of the surcharge by reducing the account by the surcharge amount or an equivalent number of minutes.
(3) The service provider shall divide the total earned prepaid wireless telephone service revenue received by the provider with respect to each prepaid wireless telephone service customer in the state within the 911 monthly reporting period by $35 and multiply the quotient by the surcharge amount.
2 Effective Date. This act shall take effect January 1, 2014.

HB 284-FN - FISCAL NOTE
AN ACT providing for collection of the E-911 surcharge from certain prepaid cellular telephones.
FISCAL IMPACT:
The Department of Safety states this bill, as introduced, may increase state restricted revenues and expenditures by an indeterminable amount in FY 2014 and each year thereafter. There will be no impact on county and local revenues or expenditures.
METHODOLOGY:
The Department of Safety states this bill provides for the collection of the enhanced 911 (E-911) surcharge from prepaid cellular telephones to be credited to the E-911 fund established under RSA 106-H, which funds the E-911 system and the statewide emergency notification system. The Department states it is not currently able to accurately determine the number of prepaid cellular New Hampshire based telephone numbers that exist and would be subject to this surcharge. Therefore, the Department states the fiscal impact to state restricted revenues and expenditures is indeterminable at this time.
