STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT relative to penalties for speeding offenses.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Speed Limitations; Fines. RSA 265:60, V is repealed and reenacted to read as follows:
V. The fines for violation of paragraph II shall be as follows:
(a) Miles per hour above a posted speed limit of 25, 30, or 35 miles per hour:
1-10 $75 plus penalty assessment
11-15 100 plus penalty assessment
16-20 200 plus penalty assessment
21+ Must appear
(Minimum $350 plus penalty assessment)
(b) Miles per hour above a posted speed limit of 50 miles per hour:
1-10 $50 plus penalty assessment
11-15 75 plus penalty assessment
16-20 150 plus penalty assessment
21+ Must appear
(Minimum $350 plus penalty assessment)
(c) Miles per hour above a posted speed limit of 55 miles per hour:
1-10 $75 plus penalty assessment
11-15 125 plus penalty assessment
16-20 250 plus penalty assessment
21-24 Must appear
(Minimum $350 plus penalty assessment)
25+ Must appear
(Minimum $350 plus penalty assessment
and suspension of the person’s license or privilege to
to drive for not less than 15 days)
(d) Miles per hour above a posted speed limit of 65 miles per hour:
1-10 $50 plus penalty assessment
11-15 150 plus penalty assessment
16-20 250 plus penalty assessment
21-24 350 plus penalty assessment
25-30 500 plus $20 for each mile per hour above 90 miles per hour
plus penalty assessment
30+ Must appear

2 Repeal. RSA 265:60, VI, relative to speed limitation fines, is repealed.
3 Effective Date. This act shall take effect January 1, 2014.

HB 666 FISCAL NOTE
AN ACT relative to penalties for speeding offenses.
FISCAL IMPACT:
The Department of Safety states this bill, as introduced, may have an indeterminable impact on state revenues, and will increase state highway fund expenditures by $27,250 in FY 2014. There will be no impact on county and local revenues or expenditures.
The Office of Legislative Budget Assistant is awaiting information from the Judicial Branch relative to the potential fiscal impact of this bill as amended. The Judicial Branch was initially contacted on 01/08/13 and most recently contacted on 08/23/13.
METHODOLOGY:
The Department of Safety states this bill changes the fine amounts for speeding offenses under RSA 260:60, V. The Department states this bill’s only impact to state expenditures would result from necessary software changes. The Department estimates these costs to total $27,250 in FY 2014, which would come from the state highway fund. The Department states this bill may also have an impact on state general fund revenue, highway fund revenue, and restricted revenue to the Department. However, the Department is unable to estimate the impact as the number of offenders, amounts of fines and rate of collection are not known.
