SENATE BILL 362
AN ACT relative to the sale of unpasteurized apple cider.

This bill allows for the sale of unpasteurized apple cider as long as the container is labeled and the container is kept appropriately cold until it is sold.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT relative to the sale of unpasteurized apple cider.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Sale of Unpasteurized Apple Cider. RSA 434:40-b, V is repealed and reenacted to read as follows:
V. Unpasteurized or raw cider may be sold so long as:
(a) Containers of such cider shall be marked with:
(1) A designation that such cider is unpasteurized or raw.
(2) The name and address of the place where the cider was produced.
(3) A warning label that reads:
“WARNING: This product has not been pasteurized and, therefore, may contain harmful bacteria that can cause serious illness in children, the elderly, and persons with weakened immune systems.”
(4) The date the cider was packaged.
(5) The date the cider will expire.
(b) Retailers shall keep the cider refrigerated at a temperature of 45 degrees Fahrenheit or less, or set in ice.
VI. All unpasteurized or raw cider in bulk containers sold directly to consumers, restaurants or any other markets where cider is not further processed before purchase by the consumer shall be labeled with the same information required on packaged cider. However, the labeling requirements shall not apply to bulk cider containers used solely for transportation or storage of cider prior to being processed or packaged for consumer sales.
2 Effective Date. This act shall take effect 60 days after its passage.
