AN ACT relative to appointments and nominations to boards, commissions, or other entities by the New Hampshire Municipal Association.

ANALYSIS

This bill provides that certain appointment or nomination authority granted to the New?Hampshire Municipal Association shall apply to persons from a municipality which is eligible for membership in the New Hampshire Municipal Association.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to appointments and nominations to boards, commissions, or other entities by the New Hampshire Municipal Association.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Public Works Employee Memorial Committee. Amend RSA 4:9-k, I(c) to read as follows:

(c) One member [appointed by the] from a town or city eligible for membership in the New Hampshire Municipal Association, appointed by the association.

2 Wetlands Council. Amend RSA 21-O:5-a, I(g) to read as follows:

(g) Eight members of the public appointed by the governor and council for a term of 3 years or until a successor is chosen. One of these shall be a member of a municipal conservation commission at the time of appointment, and be one of 3 nominees submitted by the New Hampshire Association of Conservation Commissions; one shall be a supervisor, associate supervisor, former associate supervisor, or former supervisor, of a conservation district at the time of appointment, and be one of 3 nominees submitted by the New Hampshire Association of Conservation Districts; one shall be an elected municipal official at the time of appointment from a town or city eligible for membership in the New Hampshire Municipal Association, and be one of 3 nominees submitted by the New Hampshire Municipal Association; one shall be a natural resource scientist and be one of 3 nominees submitted by the New Hampshire Association of Natural Resource Scientists; one shall be a member of the construction industry and be one of 3 nominees submitted by the Associated General Contractors of New Hampshire; one shall be a member of the marine industry and be one of 3 nominees submitted by the New Hampshire Marine Trades Association; one shall have experience in environmental protection and resource management at the time of appointment and be one of 4 nominees submitted, 2 each, by the New Hampshire Audubon Society and the Society for the Protection of New Hampshire Forests; and one shall be a farm or forest landowner and be one of 2 nominees submitted, one each, by the New Hampshire Farm Bureau Federation and the New Hampshire Timberland Owners Association. One member of the council shall be elected annually as chairperson by the members of the council.

3 Waste Management Council. Amend RSA 21-O:9, I(b) to read as follows:

(b) Three municipal officials from a town or city eligible for membership in the New?Hampshire Municipal Association, at least 2 of whom shall be elected officials, representing the public interest, nominated by the New Hampshire Municipal Association;

4 Fire Standards and Training Commission. Amend RSA 21-P:26, I(g) to read as follows:

(g) One representative [of the] from a town or city eligible for membership in the New Hampshire Municipal Association.

5 Municipal Records Board. Amend RSA 33-A:4-a, I(g) to read as follows:

(g) A municipal treasurer or finance director from a town or city eligible for membership in the New Hampshire Municipal Association appointed by the president of the New Hampshire Municipal Association for a 3-year term.

6 Municipal Bond Bank Directors. Amend RSA 35-A:4, II to read as follows:

II. The bank shall consist of 5 directors. The state treasurer shall be an ex officio member without further appointment. Four directors shall be appointed by the governor and council for terms of 5 years each. Of these 4 directors, one shall be [a designee of] from a town or city eligible for membership in the New Hampshire Municipal Association, designated by the association. At least 2 of the appointed directors shall have backgrounds in public finance. Vacancies shall be filled for the unexpired term. Each director shall hold office until his or her successor has been appointed and qualified.

7 Retirement System Board of Trustees. Amend RSA 100-A:14, I to read as follows:

I. The administration of this system is vested in a board of 13 trustees. Each newly appointed or reappointed trustee shall have familiarity with or experience in finance or business management. The state treasurer shall be an ex officio voting member of the board. The governor and council shall appoint 4 trustees, to be known as nonmember trustees, who shall be qualified persons with investment and/or financial experience as provided in this paragraph and not be members of the system, and who shall serve for a term of 2 years and until their successors are appointed and qualified. The nonmember trustees of the board shall have substantial experience in the field of institutional investment or finance, taking into account factors such as educational background, business experience, and professional licensure and designations. The original appointment of the nonmember trustees shall be made to provide for staggered terms. The remaining 8 members of the board shall consist of: one employee member, one teacher member, one permanent police member, one permanent fireman member, and 4 employer members. The New?Hampshire state employees’ association, the New Hampshire education association, the New?Hampshire police association, and the New Hampshire state permanent firemen’s association shall each annually nominate from their members a panel of 5 persons, all of whom shall be active members of the retirement system, no later than May 31 of each year, and the panels so named shall be filed with the secretary of state no later than June 10 of each year. From the above named panels the governor and council shall appoint the active member trustees of the board as needed so as to maintain the representation on the board. The governor and council shall appoint the employer members of the board with one member nominated by the New Hampshire Association of Counties, one member from a town or city eligible for membership in the New Hampshire Municipal Association nominated by the New Hampshire Municipal Association, one member nominated by the New Hampshire School Boards Association, and one member to represent management of state employees. Members appointed to the board in the manner aforesaid shall serve for a term of 2 years. Each member so appointed shall hold office until his or her successor shall be appointed and qualified. Whenever a vacancy occurs, the governor and council shall fill the vacancy by appointing a member who shall serve for the unexpired term. The governor shall designate one of the nonmember trustees to serve as chairman of said board of trustees.

8 Length of Service Awards Program Committee. Amend RSA 100-B:9, I(b) to read as follows:

(b) One member [appointed by the] from a town or city eligible for membership in the New Hampshire Municipal Association, appointed by the association.

9 Enhanced 911 Commission. Amend RSA 106-H:3, I(a)(5) to read as follows:

(5) New Hampshire Municipal Association, provided the member may be an active municipal official from a town or city eligible for membership in the New?Hampshire?Municipal Association.

10 Emergency Medical and Trauma Services Coordinating Board. Amend RSA 153-A:3, II(c) to read as follows:

(c) One member from a town or city eligible for membership in the New Hampshire Municipal Association.

11 State Building Code Review Board. Amend RSA 155-A:10, I(e) to read as follows:

(e) One representative of the state’s municipalities from a town or city eligible for membership in the New Hampshire Municipal Association, nominated by the New Hampshire Municipal Association.

12 Statewide Trail System Advisory Committee. Amend RSA 216-F:5, I to read as follows:

I. The commissioner shall appoint a New Hampshire statewide trail system advisory committee, for the purposes of advising the director of parks and recreation on matters related to the New Hampshire statewide trail system. The members shall equally represent the different trail interests involved and the general public. This committee shall include, but not be limited to, representation from the following: the bureau of trails; department of fish and game; office of energy and planning; department of transportation; governor’s commission on disability; New Hampshire Snowmobile Association; a representative of Granite State ATV Association; Appalachian Mountain Club; a town or city eligible for membership in the New Hampshire Municipal Association; Society for the Protection of New Hampshire Forests; the New Hampshire Heritage Trail; the New?Hampshire Farm Bureau Federation; the New Hampshire Horse Council, Inc.; the New?Hampshire Mushers Association; a representative of landowners; and the bicycle trail coordinator from the department of transportation.

13 Public Deposit Investment Pool Advisory Committee. Amend RSA 383:24, I(f) to read as follows:

(f) One city finance officer[, appointed by] from a city eligible for membership in the New Hampshire Municipal Association, appointed by the association.

14 Pesticide Control Board. Amend RSA 430:30, I(l) to read as follows:

(l) One person representing municipal interests from a town or city eligible for membership in the New Hampshire Municipal Association, appointed by the governor from 3 candidates nominated by the New Hampshire Municipal Association.

15 Rivers Management Advisory Committee. Amend RSA 483:8, I(b) to read as follows:

(b) A municipal officer [nominated by] from a town or city eligible for membership in the New Hampshire Municipal Association, nominated by the association.

16 Lakes Management Committee. Amend RSA 483-A:6, II to read as follows:

II. The advisory committee shall include the following members to be appointed by the governor and council:

(a) A member representing a New Hampshire lake association nominated by the New?Hampshire Lakes Association.

(b) A member representing the state conservation committee established in RSA 432:10.

(c) A member of the fish and game commission.

(d) A municipal officer of a lakefront community [nominated by] from a town or city eligible for membership in the New Hampshire Municipal Association, nominated by the association.

(e) A member of a conservation commission from a lakefront community nominated by the New Hampshire Association of Conservation Commissions.

(f) A member representing the scientific community nominated by the university system of New Hampshire.

(g) A member representing the tourism industry nominated by the New Hampshire Travel Council.

(h) A member representing conservation interests nominated jointly by the Loon Preservation Committee, the Society for the Protection of New Hampshire Forests, the Audubon Society of New Hampshire, and the New Hampshire Wildlife Federation.

(i) A member representing the New Hampshire Marine Trades Association.

(j) A member of the New Hampshire Association of Realtors.

(k) A member of a planning board [appointed by] from a town or city eligible for membership in the New Hampshire Municipal Association, appointed by the association.

(l) A member representing the Business and Industry Association of New Hampshire.

17 Effective Date. This act shall take effect 60 days after its passage.
