AN ACT relative to state reimbursement of cities and towns for funds received under river management compacts.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to state reimbursement of cities and towns for funds received under river management compacts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Flood Control Compacts; Reimbursements to Cities and Towns. Amend RSA?122:4 by inserting after paragraph II the following new paragraph:

III. If any state that entered into a river management compact with the state of New?Hampshire makes a payment in any amount on an arrearage to the state of New Hampshire, then within 30 days of receiving such payment, the state treasurer shall distribute such money to the towns affected by the compact in the manner prescribed by paragraph I for funds not otherwise appropriated for the fiscal years ending June 30, 2012 and June 30, 2013. Any additional funds shall lapse to the general fund.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 370-FN-LOCAL - FISCAL NOTE

AN ACT relative to state reimbursement of cities and towns for funds received under river management compacts.

FISCAL IMPACT:

    The Department of Revenue Administration states this bill, as introduced, may decrease state general fund revenue, increase state restricted revenue and expenditures, and increase local revenue by $1,085,344 in FY 2014. There will be no impact on county revenue, or county and local expenditures.

METHODOLOGY:

    The Department of Revenue Administration states this bill requires the state treasurer to distribute to the affected cities and towns any payments made by another state on an arrearage due under a river management compact. The Department states that the state is currently attempting to collect $1,085,344 from the Commonwealth of Massachusetts for reimbursements owed during FY 2012 and FY 2013. If this amount is recovered as a result of pending litigation, the bill would result in a one-time decrease in state general fund revenue and a corresponding increase in local revenue equal to the amount collected. If the reimbursement is not collected, there will be no liability to the general fund.
