STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT making a supplemental appropriation to the department of safety for municipal disaster assistance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation; State Matching Funds for Disaster Assistance Grants. If on June 30, 2014, the state budget surplus exceeds $4,976,845, the sum of $4,976,845 or the amount necessary to reimburse municipalities that, as of June 30, 2014, have received federal disaster assistance from the Federal Emergency Management Agency (FEMA) and have not received the traditional 12.5 percent match of state funds, whichever is greater, is hereby appropriated to the department of safety, division of homeland security and emergency management. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated. Any unexpended funds appropriated in this section shall not lapse to the general fund until June 30, 2015. The appropriation in this section shall be in addition to any other funds appropriated for such purpose. With prior approval of the fiscal committee of the general court, the department of safety, division of homeland security and emergency management, shall distribute the funds appropriated by this section to eligible municipalities. The funds shall be distributed pursuant to the following funding formula: federal funds shall be used for 75 percent of eligible costs and the remaining 25 percent of costs shall be divided equally between the state and municipality.

2 Effective Date. This act shall take effect July 1, 2014.

SB 409-FN-A-LOCAL - FISCAL NOTE

AN ACT making a supplemental appropriation to the department of safety for municipal disaster assistance.

FISCAL IMPACT:

The Department of Safety states this bill, as introduced, will increase state general fund expenditures and local revenues by an indeterminable amount in FY 2015 and each year thereafter. There will be no impact on state and county revenue, or county and local expenditures.

This bill appropriates $4,976,845 from the state general fund to the Department of Safety in the fiscal year ending June 30, 2015 for the purposes of this act. The appropriation is contingent upon the state general fund budget surplus exceeding $4,976,845 as of June 30, 2014.

METHODOLOGY:

The Department of Safety states this bill, contingent upon the state general fund budget surplus exceeding $4,976,845 in FY 2014 as of June 30, 2014, appropriates $4,976,845, or the amount necessary, to the Department of Safety for the purpose of providing a state match for federal disaster assistance grants received by municipalities as of June 30, 2014. The department states the amount of $4,976,845 represents the state’s share of a funding formula of 12.5% state, 12.5% municipality, and 75% federal for disasters occurring between February 2010 and July 2013. The Department states it cannot predict how many federal disasters may be declared by the June 30, 2014, and therefore cannot estimate additional appropriations, if any, necessary to reimburse municipalities.
