STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to table stakes poker.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Poker Games; Table Stakes. Amend RSA 287-D:3, V to read as follows:

V. No single wager by a player, on any game of chance, shall exceed the amount of $4. Provided, however, that in games of poker where the chips have monetary value, play may be conducted under “table stakes” rules where the amount of blinds, antes, and any other type of forced bet shall not exceed $4 per player but the amount wagered by a player during the play of a hand shall not be limited except by the amount of chips the player has in his or her possession on the table. In any such “table stakes” game, the amount of chips a player may purchase at any one time for use in said game shall be no greater in value than $150.

2 Effective Date. This act shall take effect January 1, 2014.

SB 61-FN - FISCAL NOTE

AN ACT relative to table stakes poker.

FISCAL IMPACT:

      The Racing and Charitable Gaming Commission states this bill, as introduced, may increase state revenue by an indeterminable amount in FY 2014 and each year thereafter. There is no fiscal impact on county and local revenue, or state, county and local expenditures.

METHODOLOGY:

    The Racing and Charitable Gaming Commission states this bill allows the playing of poker under “table stakes” rules. The Commission states where this bill would simulate poker, it is assumed more individuals would play this game. The state retains 10 percent of the “rake” (the percentage of a pot taken out by the game operators to pay the state, charity and the game operators). The Commission states game operators estimate this bill will increase the rake amounts by 100 percent. The Commission states if it used the gross amount of “rake” for FY 2012 of $3,439,858, of which $343,986 went to the state, and assumed this bill would increase that amount of “rake” by 50 percent, then state revenue would increase by approximately $171,993. The Commission is not able to determine the exact increase in state revenue resulting from this bill. The Commission states it will have no change in expenditures as it already performs enforcement and auditing functions of poker games where a rake is present.
