AN ACT establishing an oversight commission for medical cost transparency.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT establishing an oversight commission for medical cost transparency.

Be it Enacted by the Senate and House of Representatives in General Court convened:

227:1 New Subdivision; Oversight Commission on Medical Cost Transparency. Amend RSA 400-A by inserting after section 66 the following new subdivision:

Oversight Commission on Medical Cost Transparency

400-A:67 Oversight Commission on Medical Cost Transparency.

I. There is established an oversight commission on medical cost transparency to monitor and provide assistance in further developing the NH HealthCost Internet website.

II. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) The insurance commissioner, or designee.

(d) The commissioner of the department of health and human services, or designee.

(e) Two public members who shall represent New Hampshire patients, appointed by the governor.

(f) A representative of the New Hampshire Hospital Association, appointed by the association.

(g) A representative of the New Hampshire Medical Society, appointed by the society.

(h) One member representing the private health insurance industry, appointed by the governor.

(i) One member representing a self-funded workers’ compensation trust, appointed by the governor.

(j) A licensed physician who provides care for workers’ compensation patients, appointed by the governor.

III. Members of the commission shall serve without compensation, except that legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV. The commission shall monitor and provide assistance in further developing the NH HealthCost transparency Internet website to ensure that the website enhances transparency relative to access to medical services costs to help the citizens of New Hampshire in making informed health care decisions.

V. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.

VI. The commission shall make an interim report with its findings and any recommendations for proposed legislation on or before November 1, 2015 and a final report on November 1, 2016 to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

227:2 Repeal. RSA 400-A:67, relative to an oversight commission on medical cost transparency, is repealed.

227:3 Effective Date.

I. Section 2 of this act shall take effect November 1, 2016.

II. The remainder of this act shall take effect upon its passage.
