AN ACT relative to the sale of personally identifiable information by Internet service providers.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to the sale of personally identifiable information by Internet service providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Internet Privacy. Amend RSA 374 by inserting after section 22-q the following new subdivision:

Internet Privacy

374:22-r Definition. In this subdivision, “personally identifiable information” means information that identifies:

I. A consumer by physical or electronic address or telephone number;

II. A consumer as having requested or obtained specific materials or services from an Internet service provider;

III. Internet or online sites visited by a consumer; or

IV. Any of the contents of a consumer’s data-storage devices.

374:22-s Sale of Personally Identifiable Information; Option to Refuse. Internet service providers shall, in the contract for service, provide consumers with the option to refuse to agree to the sale of their personally identifiable information to third parties by the Internet service provider.

2 Effective Date. This act shall take effect 60 days after its passage.
