HOUSE BILL 360
AN ACT relative to public utilities that fail to restore service within 3 days.

This bill provides that any regulated public utility that fails to restore service to its customers within 3 days shall be liable for damages sustained by the customer.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fifteen
AN ACT relative to public utilities that fail to restore service within 3 days.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 General Public Utility Duty; Service; Liability. Amend RSA 374:1 to read as follows:
374:1 Service; Liability.
I. Every public utility shall furnish such service and facilities as shall be reasonably safe and adequate and in all other respects just and reasonable.
II. Except following a declared state of emergency, any public utility that fails to restore service within 3 days shall be liable for damages sustained by the customer that were caused by such utility’s failure to restore service by such date.
2 Effective Date. This act shall take effect January 1, 2016.
