STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to the duties of public servants.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Corrupt Practices; Delegation of Obligations. Amend RSA 640 by inserting after section 7 the following new section:

640:8 Public Servants; Delegation of Obligations Prohibited.

I. No municipal corporation’s public servants, as defined by RSA 640:2, II, shall enter into any contract with a third party which would redelegate the public servant’s existing obligations and duties to the public.

II. Any violation of paragraph I shall be ipso facto evidence for removal from office of any and all public servants participating in such unlawful action.

2 Effective Date. This act shall take effect 60 days after its passage.
