AN ACT permitting New Hampshire farmers to sell certain farm raised animals directly to the public.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT permitting New Hampshire farmers to sell certain farm raised animals directly to the public.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Amenable Species; Definition. Amend RSA 143-A:5 by inserting after paragraph VIII the following new paragraph:

IX. A farm owned or operated by any person, firm, or corporation that raises animals that are not an “amenable species” as defined by 21 United States Code, section 601(w) and sells them for human consumption, and the direct sale of the carcasses, parts, meat, and meat food products of such animals to the consumer from such farm, at the producer’s farm stand, and by the producer at farmers’ markets.

2 New Subparagraph; Amenable Species; Definition. Amend RSA 427:16, I by inserting after subparagraph (c) the following new subparagraph:

(d) The slaughtering by any person, firm, or corporation of animals that are not an “amenable species” as defined by 21 United States Code, section 601(w), and the preparation and transportation in commerce of the carcasses, parts, meat, and meat food products of such animals, exclusively for sale from the residence of the slaughterer, a farm stand owned by such slaughterer, or from farmers’ markets.

3 New Subdivision; Meat from Non-Amenable Species. Amend RSA 143-A by inserting after section 17 the following new subdivision:

Meat from Non-Amenable Species

143-A:18 Labeling. All packaging containing uninspected carcasses, parts, meat, and meat food products of animals sold by a farm exempt from licensure under RSA 143-A:5, IX shall be clearly labeled to include the following:

I. The name and address of the farm where the product originates and the date of slaughter; and

II. The statement that: “This product has been raised and processed on a New Hampshire farm and is exempt from state and federal inspection.”

4 New Subdivision; Meat from Non-Amenable Species. Amend RSA 427 by inserting after section 59 the following new subdivision:

Meat from Non-Amenable Species

427:60 Labeling. All packaging containing uninspected carcasses, parts, meat, and meat food products of animals exempt from the requirements of this chapter under RSA 427:16, I(d) shall be clearly labeled to include the following:

I. The name and address of the farm where the product originates and the date of slaughter; and

II. The statement that: “This product has been raised and processed on a New Hampshire farm and is exempt from state and federal inspection.”

5 Effective Date. This act shall take effect 60 days after its passage.
