STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to consolidation of school administrative units.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 School Administrative Units; Status. Amend RSA 194-C:1, I to read as follows:

194-C:1 Status.

I. [All school administrative units existing on the effective date of this chapter shall continue in their present form unless modified in accordance with the provisions of this chapter] There shall be one school administrative unit in each county of the state, organized pursuant to this chapter, which shall be located in the most populous city or town in each county, except that for Hillsborough county, there shall be one school administrative unit located in the city of Manchester, one school administrative unit located in the city of Nashua, and one school administrative unit for the remainder of the county located in the next most populous city or town in the county.

2 Transfer of Powers, Duties, and Responsibilities.

I. No later than November 1, 2015, the state board of education shall identify those school administrative units as defined in RSA 194-C:1, I that will continue to operate and identify those school administrative units whose operations shall cease. The state board of education shall provide a list of continuing and former school administrative units to the commissioner of the department of education.

II. Notwithstanding the procedures established in RSA 194-C:2, all functions, powers, duties, responsibilities, and funding of the former school administrative units shall be transferred to the office of the superintendent of the school administrative unit designated in RSA 194-C:1, I no later than July 1, 2018. The transfer provided in this section shall include all of the equipment, books, papers, and records of the former school administrative units. All administrative, clerical, and business processing functions of the former school administrative units shall be transferred to the office of the superintendent of the school administrative unit designated in RSA 194-C:1, I. The commissioner of the department of education, in consultation with the state board of education, may establish the number and classification of personnel required for effectively managing all statutory responsibilities and, with the prior approval of the governor and council, may eliminate unnecessary positions.

3 Effective Date. This act shall take effect July 1, 2017.

HB 566-FN-LOCAL - FISCAL NOTE

AN ACT relative to consolidation of school administrative units.

FISCAL IMPACT:

      The Department of Education states this bill, as introduced, may have an indeterminable impact on state and local expenditures, and local revenues in FY 2016 and each year thereafter. There will be no impact on state and county revenue, or county expenditures.

METHODOLOGY:

    The Department of Education states this bill consolidates school administrative units (SAU) to one per county, except for Hillsborough County, where there would be three; one in Manchester, Nashua, and the next most populous municipality in the county. Consequently, the number of SAUs in the State would decrease from ninety-two to twelve effective July 1, 2017. The Department states the ninety-two SAUs are currently funded by local school districts. The Department is unable to estimate which SAUs will remain open in each county, as it will be determined by the State Board of Education, or the duties and responsibilities it may acquire as a result of this consolidation. Therefore, it is unable to estimate this bill’s potential impact to state expenditures or local revenues and expenditures.
