AN ACT prohibiting the use of sex offender registry information for the purpose of harassing, intimidating, or threatening a registered sexual offender or offender against children, or any family member, employer, or landlord of such person.

This bill prohibits the use of sex offender registry information found on the department of safety’s Internet website for the purpose of harassing, intimidating, or threatening a registered sexual offender or offender against children, or any family member, employer, or landlord of such person.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT prohibiting the use of sex offender registry information for the purpose of harassing, intimidating, or threatening a registered sexual offender or offender against children, or any family member, employer, or landlord of such person.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Registration of Criminal Offenders; Availability of Information to the Public and Law Enforcement. Amend RSA 651-B:7 by inserting after paragraph VI the following new paragraph:

VII. No person shall use any information contained on the department’s official public Internet website to harass, intimidate, or threaten any person who is required to register pursuant to this chapter or any family member, employer, or landlord of such person. The department shall develop and post a notice on its official public Internet website warning against the prohibited uses of information found on the website and requiring users to acknowledge these prohibitions prior to accessing the website. Any person who violates the provisions of this paragraph shall be guilty of a class A misdemeanor.

2 Effective Date. This act shall take effect January 1, 2016.

AN ACT prohibiting the use of sex offender registry information for the purpose of harassing, intimidating, or threatening a registered sexual offender or offender against children, or any family member, employer, or landlord of such person.

FISCAL IMPACT:

    The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill, as introduced, as it is awaiting information from the Judicial Branch and Department of Justice, who were contacted on 01/06/15. When completed, the fiscal note will be forwarded to the House Clerk's Office.
