STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT establishing a statutory commission to study post-retirement employment of New?Hampshire retirement system retirees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Retirement System; Commission to Study Post-Retirement Employment of Retirement System Retirees. Amend RSA 100-A by inserting after section 57 the following new section:

100-A:58 Commission to Study Post-Retirement Employment of Retirement System Retirees.

I. There is hereby established a post-retirement employment commission consisting of the following members:

(a) One member of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) One public member appointed by the governor.

(d) The commissioner of the department of administrative services, or designee.

(e) Three representatives of municipal, county, and school employers in the retirement system, appointed by the governor.

(f) One representative of group I members of the retirement system, appointed by the governor.

(g) One representative of group II members of the retirement system, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate while attending to the duties of the commission.

III. The commission shall:

(a) Analyze the impact of post-retirement employment on the retirement system, employers, and retirees, and the challenges facing the retirement system in administering the limits on part-time employment in RSA 100-A:1, XXXIV.

(b) Review the current statutory exemptions to mandatory enrollment in the retirement system as a condition of full-time employment.

(c) Make recommendations for future legislation that balances the interests of stakeholders with the policy goals of the legislature, including consequences for violating the statute.

(d) Study other post-retirement matters deemed necessary by the commission.

(e) Seek technical assistance as necessary from the New Hampshire retirement system and participating employers. Subject to available appropriations, the commission may employ support staff for the purposes of its duties.

IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the member appointed by the speaker of the house of representatives. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum. The terms of the members of the commission shall be coterminous with their terms of office.

V. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before September 1, 2016.

2 Repeal. RSA 100-A:58, relative to the commission to study post-retirement employment of New Hampshire retirement system retirees, is repealed.

3 Effective Date.

I. Section 2 of this act shall take effect December 1, 2016.

II. The remainder of this act shall take effect upon its passage.
